Unlike the Schedule I and Schedule II banks, as a Schedule III bank, US Bank (Canada Branch) are NOT incorporated under the Bank Act and therefore operate in Canada under other government-mandated restrictions. Schedule III banks usually operate within the country's largest cities (being Toronto, Montreal, Calgary and Vancouver), under certain restrictions mentioned in the Act. As of October 2010, there were 23 such banks in Canada.

In Canada, the Office of the Superintendent of Financial Institutions (OSFI) is responsible for administering a number of federal statutes, including the Bank Act and the Trust and Loan Companies Act, the statutes applicable to the regulation of banks and federal trust and loan companies.
